Cut that dick! Oh no you won't?

Years ago, an Israeli friend of mine told me that he considered the fact that he was circumcised at birth, an offence caused to him by his parents. He believes that he was deprived of the fullness of sexual pleasures as a result.

A few days ago, a German court ruled that male circumcision was equal to grievous bodily harm and could only be permitted for medical reasons. Germany is a federal country and the state court ruling is not binding in the other German states. In all likelihood, however, it will be tested in the other states and probably also go up to the High Court.

Four million Muslims and about 100,000 Jews who live in Germany may have a problem. How many 18-year-old men would voluntarily undergo circumcision? The speaker of the Jewish community has already reacted with anger: "Circumcision of newborn boys is a fixed part of the Jewish religion and has been practised worldwide for centuries. This religious right is respected in every country in the world."

For many, circumcision is a cultural ritual that is almost as powerful as a religious command. A thirtsomething year old friend of mine told me that when his wife had announced to him that she was not having her son circumcised, he at first found it hard to accept. They are both Israeli Jews and atheists and he told me "I found it difficult to even consider that my son should not have the same kind of dick as I."

But are we to allow grievously bodily harm to our children just because it is a religious ritual that has been practiced for centuries? In addition to the human rights question, this could also add to the friction and issues with the growing Muslim population. This exciting decision might force the courts to define religious freedom in an ever less religious Europe. I am looking forward to it.

  1. In dieser heiklen Angelegenheit dürfte das letzte richterliche Wort noch nicht gesprochen sein. Denn anders als bei der Genitalverstümmelung von Mädchen halte ich die Beschneidung bei Knaben nicht für einen gravierenden Eingriff, der unbedingt als Körperverletzung zu qualifizieren ist.

    Gewichtiger scheint mir der Einwand eines massiven Eingriffs der Eltern in das religiöse/kulturelle Selbstbestimmungsrecht ihrer Söhne zu sein. Doch das ist nicht Gegenstand eines Strafverfahrens sondern ein familienrechtlicher bzw. Grundrechtsdisput.

  3. Schwierig etwas zu verbieten, was durch viele Jahrhunderte bei uns geduldet und akzeptiert wurde. So wird ein Einzelner bestraft für eine traditionelle Handlung, die bisher als gottgegeben nicht hinterfragt wurde. Gerade diese Diskussion ist aber dringend notwendig, damit wir endlich beurteilen können, ob die kindliche Beschneidung von Knaben im 21.Jahrhundert noch angebracht ist (aus Gründen der Hygiene, der Identitätsstiftung etc) oder ob sie vor allem das Kind traumatisiert.

  5. מענין שבדיוק היום בצהרים חשבתי שאם היה נולד לי כעת תינוק אני בטוחה שלא הייתי נותנת למול אותו. בברית של הבן נשארתי בבית כי לא יכלתי לעמוד באכזריות. זה נראה לי אקט כל כך אכזרי ומבעית שלא סלחתי לעצמי עוד ימים רבים אחר כך שנתתי לכך יד באי התנגדותי. ת

    ימים יגידו מה יהא גורל הדור הבא שיוולד כאן - ממידע אישי שליקטתי באקלקטיות אני יכולה לומר לך שיש קבוצות הורים צעירים שלא מלים את בניהם מתוך עיקרון אי פגיעה בשלמות הגוף ומתן חופש בחירה לאדם שיחליט לכשיתבגר האם הוא חפץ להיות נמול או לאו. ת

  7. Since I can't read German or Hebrew hope I'm not repeating anyone. We had both of our boys circumcised by a mohel in a bris ceremony. Our thinking was that the hygienic/medical grounds for doing so were dubious so let's do the deed in the religious context that was our real reason. Since then it's been determined that circumcision is an effective AIDS preventive, and perhaps hygienic after all.

  8. Parents should wait until theirs kids are gown-up - so they can decide by themselves -
    Apart from this, I think "to cut" is an absolute nonsense.
